Welcome to BuyDirectAfrica.com (the "Site", "Platform", "we", "us", or "our"). These Terms and Conditions govern your access to and use of our multi-vendor marketplace website and any associated mobile applications.

By registering an account, purchasing goods, or listing products as a Vendor, you agree to be legally bound by these Terms. If you do not agree, please do not use the Platform.

 

1. The Nature of Our Platform

BuyDirectAfrica.com is an online multi-vendor marketplace platform. We provide the technology that allows independent Sellers ("Vendors") to list, market, and sell goods directly to Buyers ("Customers").

• No Direct Sale: Unless expressly stated otherwise on a specific listing, BuyDirectAfrica.com does not own, manufacture, stock, or ship the products sold on the Site.
• The Contract: The contract for the sale of any product is strictly between the Buyer and the Vendor.

 

2. User Accounts and Eligibility

• Age: You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account.
• Accuracy: You agree to provide true, accurate, and current information during registration.
• Security: You are entirely responsible for maintaining the confidentiality of your account credentials and password.

 

3. Buyer Terms and Payments

• Pricing and Currency: All prices are set by individual Vendors. Total checkout prices include product costs, applicable taxes, and calculated shipping fees.
• Secure Payments: Buyers must pay for transactions using the authorized payment gateways provided by our Yo!Kart system.
• Order Fulfillment: Vendors are independently responsible for dispatching packages and updating valid tracking data within the designated time frame.

 

4. Vendor and Seller Rules

Vendors listing goods on BuyDirectAfrica.com agree to the following terms:

• Legality: You will not list prohibited, counterfeit, stolen, dangerous, or illegally exported African goods.
• Honesty: Product descriptions, origins, material compositions, and shipping timelines must be fully accurate.
• Fees: You agree to the platform commission fees, payment processing deductions, or subscription structures outlined in your Vendor Agreement.
• Taxation: Vendors are solely responsible for calculating, collecting, and reporting local or international sales taxes and customs tariffs.

 

5. Prohibited Platform Activities

Users and Vendors may not:

• Use the platform to commit fraud, money laundering, or illegal trade practices.
• Circumvent the platform checkout system to execute private, off-site transactions with matched buyers/sellers.
• Post malicious software, scrape site data, or interfere with website servers.
• Leave fraudulent, manipulative, or defamatory product reviews.

 

6. Returns, Refunds, and Dispute Resolution

• Vendor Policies: Every Vendor operates under a specific return and refund timeline visible on their storefront profile.
• Escalation: If a dispute arises between a Buyer and a Vendor regarding a damaged or missing order, both parties must first attempt to resolve it directly.
• Platform Mediation: If a resolution cannot be reached, users may file an official ticket. BuyDirectAfrica reserves the final right to mediate and issue refunds from held escrow payments if necessary.

 

7. Intellectual Property

The logo, design, website layouts, trademarked text, and source code of BuyDirectAfrica.com are the exclusive property of our company. Product images and brand descriptions uploaded by Vendors remain the intellectual property of the respective Vendor, who grants us a royalty-free license to display them for marketing purposes.

 

8. Limitation of Liability

To the maximum extent permitted by law, BuyDirectAfrica.com shall not be held liable for any indirect, incidental, or consequential damages arising from defective products, Vendor shipping delays, or transactional disputes between platform users. All items are purchased "as-is" from independent sellers.

 

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of [Insert Your Base Country, e.g., Nigeria, Kenya, USA], without regard to conflict of law principles.

 

10. Modifications
